ಕಾಮವೆಂಬುದು ಸತ್ಯವೆಂದ ಮೇಲೆ ವೇಶ್ಯಾವಾಟಿಕೆಯೇಕೆ ಅಪಥ್ಯ?

“ಅದು ಜಗತ್ತಿನ ಅತ್ಯಂತ ಪುರಾತನ ವೃತ್ತಿ ಎಂದು ನೀವೇ ಹೇಳುವುದಾದರೆ, ಕಾನೂನಿನ ಮೂಲಕ ತಡೆಯಲು ಸಾಧ್ಯವಾಗುತ್ತಿಲ್ಲ ಎಂದಾದರೆ ಅದನ್ನು ಏಕೆ ಕಾನೂನುಬದ್ಧಗೊಳಿಸಬಾರದು? ಮಹಿಳೆಯರ ಮಾರಾಟ, ಸಾಗಾಟವನ್ನು ತಡೆಯಲು ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಕಾನೂನುಬದ್ಧ ಗೊಳಿಸುವುದೇ ಯೋಗ್ಯ ಮಾರ್ಗ ಹಾಗೂ ಜಗತ್ತಿನ ಯಾವ ರಾಷ್ಟ್ರ ದಲ್ಲೂ ಕಠಿಣ ಕ್ರಮಗಳ ಮೂಲಕ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ತಡೆಯಲು ಸಾಧ್ಯವಾಗಿಲ್ಲ”.
ಹಾಗಂತ ಸುಪ್ರೀಂಕೋರ್ಟ್ ನ್ಯಾಯಮೂರ್ತಿಗಳಾದ ದಳವೀರ್ ಭಂಡಾರಿ ಮತ್ತು ಎ.ಕೆ. ಪಟ್ನಾಯಕ್ ಡಿಸೆಂಬರ್ ೯ರಂದು ಕೇಂದ್ರದ ಸಾಲಿಸಿಟರ್ ಜನರಲ್ ಗೋಪಾಲ್ ಸುಬ್ರಹ್ಮಣ್ಯಂ ಅವರನ್ನು ಪ್ರಶ್ನಿಸಿದ್ದಾರೆ!
ನಮ್ಮ ದೇಶದಲ್ಲಿ ಭಾರೀ ಪ್ರಮಾಣದಲ್ಲಿ ನಡೆಯುತ್ತಿರುವ ಹೆಣ್ಣು ಮಕ್ಕಳ ಮಾರಾಟ, ಸಾಗಾಟವನ್ನು ತಡೆಯಲು ಸೂಕ್ತಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಸರಕಾರಕ್ಕೆ ನಿರ್ದೇಶನ ಕೋರಿ ‘ಬಚ್‌ಪನ್ ಬಚಾವೋ ಆಂದೋಲನ್” ಎಂಬ ಸ್ವಯಂಸೇವಾ ಸಂಸ್ಥೆ ಸುಪ್ರೀಂ ಕೋರ್ಟ್‌ನಲ್ಲಿ ಸಲ್ಲಿಸಿದ್ದ ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿ ಅರ್ಜಿಯ(PIL) ವಿಚಾರಣೆ ನಡೆಸುತ್ತಿದ್ದಾಗ ಸರಕಾರಕ್ಕೆ ಈ ರೀತಿಯ ಪ್ರಶ್ನೆ ಹಾಕಲಾಗಿದೆ. ಸುಪ್ರೀಂಕೋರ್ಟ್‌ನ ಈ ಪ್ರಶ್ನೆಯ ಬಗ್ಗೆ ನಾವೆಲ್ಲರೂ ಮಡಿವಂತಿಕೆಯನ್ನು ಬಿಟ್ಟು, ಹುಸಿ ನೈತಿಕ ಪ್ರeಯನ್ನು ಬದಿಗಿಟ್ಟು ಚಿಂತನೆ ನಡೆಸಬೇಕಾದ ಕಾಲ ಖಂಡಿತ ಬಂದಿದೆ. After all, there is nothing holy or unholy about sex! ಒಂದು ಜೋಕು ಕೇಳಿ… ಒಬ್ಬ ರಾಜಕುಮಾರ ಇರುತ್ತಾನೆ. ಅವನ ರಾಜ್ಯದಲ್ಲೇ ಮತ್ತೊಬ್ಬ ವ್ಯಕ್ತಿ ಇರುತ್ತಾನೆ. ಆ ವ್ಯಕ್ತಿ ಹಾಗೂ ರಾಜಕುಮಾರ ಇಬ್ಬರೂ ಒಂದೇ ರೀತಿ ಇರುತ್ತಾರೆ, ಒಬ್ಬರನ್ನೊಬ್ಬರು ನೂರಕ್ಕೆ ನೂರು ಎನ್ನುವಷ್ಟು ಹೋಲುತ್ತಿರುತ್ತಾರೆ. ಆ ವಿಷಯ ರಾಜಕುಮಾರನಿಗೂ ಗೊತ್ತಿರುತ್ತದೆ. ಕಾರಣ ತಿಳಿದುಕೊಳ್ಳಬೇಕೆಂಬ ಆಸಕ್ತಿ ಆತನಿಗಿದ್ದರೂ ಹೇಗೆ ತಾನೇ ಕೇಳುವುದು? ರಾಜಕುಮಾರನಿಗೊಂದು ಉಪಾಯ ಹೊಳೆಯುತ್ತದೆ. ಆ ವ್ಯಕ್ತಿಯನ್ನು ಅರಮನೆಗೆ ಕರೆಸುತ್ತಾನೆ. ಒಂದಿಷ್ಟು ಕುಶಲ ವಿಚಾರಣೆಯ ನಂತರ ಕೇಳುತ್ತಾನೆ.
ರಾಜಕುಮಾರ: ನಿಮ್ಮ ತಾಯಿಯೇನಾದರೂ ಅರಮನೆಗೆ ಕೆಲಸಕ್ಕೆ ಬರುತ್ತಿದ್ದಳೆ?
ವ್ಯಕ್ತಿ: ಇಲ್ಲಾ ಇಲ್ಲಾ.. ಆದರೆ ನಮ್ಮ ಅಪ್ಪ ರಾಣಿಯ ಬಟ್ಟೆ ತೊಳೆ ಯಲು ಆಗಾಗ್ಗೆ ಅಂತಃಪುರಕ್ಕೆ ಹೋಗುತ್ತಿದ್ದ!!
ಸೆಕ್ಸ್ ಅನ್ನುವುದು ಒಂದು ದೈಹಿಕ ಅಗತ್ಯ. ಅದನ್ನು ಒಂದು ದೌರ್ಬಲ್ಯ ಎನ್ನುವುದಾದರೆ ನಮ್ಮ ಋಷಿಮುನಿಗಳು, ದೇವರಲ್ಲೂ ಆ ದೌರ್ಬಲ್ಯವಿತ್ತು. ಮಹಾನ್ ತಪಸ್ವಿ ವಿಶ್ವಾಮಿತ್ರನೇ ಮೇನಕೆಗೆ ಮಾರುಹೋಗಲಿಲ್ಲವೆ? ಋಷಿಪತ್ನಿ ಅಹಲ್ಯೆ ಯನ್ನು ಇಂದ್ರ ಮೋಸದಿಂದ ಸೇರಲಿಲ್ಲವೆ? ಸ್ವಾಮಿ ವಿವೇಕಾನಂದ ಅವರಂತಹ ಕೆಲವರನ್ನು ಬಿಟ್ಟರೆ ಬೇರಾರಿಂದಲೂ ಆ ಬಯಕೆಯನ್ನು ಮೆಟ್ಟಿ ಮೀರಿ ನಿಲ್ಲಲಾಗಲಿಲ್ಲ. ಅದೊಂದು ಸ್ವಾಭಾವಿಕ ಪ್ರಕ್ರಿಯೆ. ಆದರೆ ಮದ್ಯ ಸೇವನೆ ಅಗತ್ಯವೂ ಅಲ್ಲ, ಸ್ವಾಭಾವಿಕವೂ ಅಲ್ಲ. ಹಾಗಿದ್ದರೂ ಮದ್ಯಪಾನವನ್ನು ಕಾನೂನುಬದ್ಧಗೊಳಿಸಿ, ಅದಕ್ಕೆ ತೆರಿಗೆ ಹಾಕಿ ಆದಾಯಗಳಿಸಬಹುದಾದರೆ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಏಕೆ ಲೀಗಲೈಸ್ ಮಾಡಬಾರದು? ನೀವೇ ಹೇಳಿ, ಕಾನೂನು ಅಥವಾ ಇನ್ನಾವುದೇ ಮಾರ್ಗಗಳ ಮೂಲಕ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ತಡೆಗಟ್ಟಲು ಸಾಧ್ಯವೆ?
ಇದೊಂದು timeless ಚರ್ಚೆ!
ವೇಶ್ಯಾವಾಟಿಕೆಯೆಂಬುದು ಇವತ್ತು ಕೇವಲ ನೈತಿಕತೆ ಪ್ರಶ್ನೆಯಾಗಿ ಉಳಿದಿಲ್ಲ. ವೇಶ್ಯಾವಾಟಿಕೆಯಲ್ಲಿ ತೊಡಗಿರುವವರು ನೈತಿಕವಾಗಿ ಅಧಃಪತನಕ್ಕಿಳಿದಿರುವವರು ಹಾಗೂ ಸಾಮಾಜಿಕ ಪೀಡೆಗಳೋ? ವೇಶ್ಯಾವಾಟಿಕೆಯೆಂಬುದು ಒಂದು ರೀತಿಯ ದೌರ್ಜನ್ಯವಾಗಿದ್ದು ಅದನ್ನು ನಿಷೇಧಿಸಬೇಕೋ ಅಥವಾ ಅದೂ ಒಂದು ವೃತ್ತಿಯಾಗಿದ್ದು ಅದನ್ನು ಕಾನೂನುಬದ್ಧಗೊಳಿಸಬೇಕೋ? ಇಂಥ ವಾದಗಳೆದ್ದಿವೆ. ಇಲ್ಲೂ ಕೂಡ ‘ಐಚ್ಛಿಕ’ ಹಾಗೂ ‘ಅನಿವಾರ್ಯ’ ಎಂಬ ವಾದಗಳಿವೆ. ಅದನ್ನು ನಿಷೇಧಿಸಬೇಕು ಎನ್ನುವವರು, ಭಾರೀ ಸಂಖ್ಯೆಯಲ್ಲಿ ಹೆಣ್ಣುಮಕ್ಕಳನ್ನು ಒತ್ತಡದ ಮೂಲಕ ವೇಶ್ಯಾವಾಟಿಕೆಗೆ ದೂಡುತ್ತಿದ್ದಾರೆ ಎಂಬ ವಾದವನ್ನು ಮುಂದಿಟ್ಟರೆ, ಹಾಗೇನೂ ಇಲ್ಲ ಎಂದು ವಾದಿಸುವವರೂ ಇದ್ದಾರೆ. ಏಯ್ಡ್ಸ್ ಪೀಡಿತ ಭಾರತೀಯ ಬ್ರಾಥೆಲ್‌ಗಳನ್ನು (ವೇಶ್ಯಾಗೃಹ) ಸೇರುವ 10-12 ವರ್ಷದ ನೇಪಾಳಿ ಯುವತಿಯರು ಖಂಡಿತ ಇಂಥದ್ದೊಂದು ಗುಲಾಮಗಿರಿಯನ್ನು ದುಃಸ್ವಪ್ನದಲ್ಲೂ ಬಯಸುವುದಿಲ್ಲ. ಮಾದಕ ವ್ಯಸನಿಗಳು ದೈನಂದಿನ ‘ಡೋಸ್’ಗಾಗಿ ಪಿಂಪ್‌ಗಳು(ತಲೆಹಿಡುಕರ) ಹೇಳಿದಷ್ಟು ಗಿರಾಕಿಗಳಿಗೆ ಮನರಂಜನೆ ನೀಡುವ ಅನಿವಾರ್ಯತೆಯಲ್ಲಿರುತ್ತಾರೆ. ಹಿಂದಿನ ಸೋವಿಯತ್ ಒಕ್ಕೂಟಕ್ಕೆ ಸೇರಿದ ರಾಷ್ಟ್ರಗಳ ಯುವತಿಯರು ವೃತ್ತಿಯನ್ನರಸಿಕೊಂಡು ಏಷ್ಯಾ, ಯುರೋಪ್‌ಗೆ ಬಂದು ಹೊಟ್ಟೆಪಾಡಿಗಾಗಿ ವೇಶಾಗೃಹ ಸೇರುತ್ತಿರುವುದೂ ಇದೆ. Again, ಉದ್ಯೋಗವೆಂಬ ಮಾರುಕಟ್ಟೆಯಲ್ಲಿ ಯಾವತ್ತು ವೃತ್ತಿ ಆಯ್ಕೆಯ ಸ್ವಾತಂತ್ರ್ಯವಿತ್ತು? ಕೆಮಿಕಲ್ ಕಾರ್ಖಾನೆಯಲ್ಲಿ ಕೆಲಸ ಮಾಡುವ ಕಾರ್ಮಿಕನೊಬ್ಬ ಬಡತನ ರೇಖೆಯಿಂದ ಎಂದೂ ಮೇಲೆ ಬರಲು ಸಾಧ್ಯವಿಲ್ಲ. ಅಂತಹ ಬದುಕನ್ನು ಅವನು ಆಯ್ಕೆ ಮಾಡಿಕೊಂಡಿದ್ದನೆ? ವಿದ್ಯೆ ಅಥವಾ ಯಾವುದೇ ಕೌಶಲಗಳನ್ನು ಗಳಿಸಿಕೊಳ್ಳುವಂತಹ ಸಣ್ಣ ಅವಕಾಶವೂ ಇಲ್ಲದ ಕೌಟುಂಬಿಕ ಹಿನ್ನೆಲೆಯಿಂದ ಬಂದ ಹೆಣ್ಣೊಬ್ಬಳು ಏನು ಮಾಡಬೇಕು? ಈ ‘ಆಯ್ಕೆ’ ಸ್ವಾತಂತ್ರ್ಯವನ್ನು ವೇಶ್ಯಾವಾಟಿಕೆಗೆ ಮಾತ್ರ ಏಕೆ ಅನ್ವಯ ಮಾಡಬೇಕು? ಹೀಗೂ ವಾದಿಸುವವರಿದ್ದಾರೆ. To get rich is to be glorious ಎಂಬ ಮಾತಿನಂತೆ ಯಾವುದೇ ಪ್ರಭಾವ, ಹಣಬಲ, ಬುದ್ಧಿಬಲ ಇಲ್ಲದ ಹುಡುಗಿಯೊಬ್ಬಳು ಶೀಘ್ರ ಸಂಪಾದನೆಗಾಗಿ ತನ್ನ ದೇಹವನ್ನೇ ಸಂಪನ್‘ಮೂಲ’ವಾಗಿ ಮಾಡಿಕೊಂಡಿರುವುದನ್ನೂ ಕಾಣಬಹುದು. ಯಾವುದೋ ಕಾರ್ಖಾನೆ, ಕಂಪನಿಯಲ್ಲಿ ಮೂರು ಕಾಸಿಗಾಗಿ ದುಡಿಯುವುದಕ್ಕಿಂತ ಈ ಮಾರ್ಗವೇ ಒಳ್ಳೆಯದೆಂಬುದು ಅವಳ ಯೋಚನೆಯಾಗಿರಬಹುದು. ದುಡ್ಡಿಗಾಗಿ ನೇರವಾಗಿ ದೇಹ ಮಾರಿಕೊಳ್ಳುವವಳಿಗೆ ವೇಶ್ಯೆ ಎನ್ನುತ್ತೀರಿ. ಆದರೆ ಯೋಗ್ಯ ಕೆಲಸದ ಹೆಸರಿನಲ್ಲಿ ಅದೇ ದಂಧೆ ನಡೆಯುತ್ತಿಲ್ಲವೆ? ಸಿನಿಮಾಗಳಲ್ಲಿ ಮೈಮಾಟ ತೋರಿಸುತ್ತಿರುವವರೂ ದುಡ್ಡಿಗಾಗಿಯೇ ಅಲ್ಲವೆ? ಇಂತಹ ಹತ್ತಾರು ಪ್ರಶ್ನೆ, ಪ್ರತಿ ಪ್ರಶ್ನೆಗಳಿಂದಾಗಿ ವೇಶ್ಯಾವಾಟಿಕೆಯ ಬಗೆಗಿನ ಚರ್ಚೆ ಕಾಲಾತೀತವಾಗಿ, never ending ಆಗಿ ಬಿಟ್ಟಿದೆ. ಇಷ್ಟಾಗಿಯೂ ಒಂದಂತೂ ಸತ್ಯ, ಇದು ಯಾವ ಕಾನೂನಿನಿಂದಲೂ ತಡೆಯಲಾಗದ, ಯಾವ ಕಾನೂನಿಗೂ ಬಗ್ಗದ ಸಮಸ್ಯೆ.
ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಲೀಗಲೈಸ್‌ಮಾಡುವುದೇ ಯೋಗ್ಯ ಮಾರ್ಗ ಎಂದೆನಿಸುತ್ತದೆ!
“ಪ್ರಾಸ್ಟಿಟ್ಯೂಶನ್ ಎಂಬುದು ಗಂಡಸು ಸೃಷ್ಟಿಸಿರುವ ಸಮಸ್ಯೆ” ಎಂದು ಚಾಣಕ್ಯ ಆ ಕಾಲದಲ್ಲೇ ಹೇಳಿದ್ದ. ಜತೆಗೆ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಕಾನೂನುಬದ್ಧಗೊಳಿಸಿ, ತೆರಿಗೆ ವಿಧಿಸಿದ್ದ. ಇವತ್ತು ಜರ್ಮನಿ, ಗ್ರೀಸ್, ನೆದರ್ಲೆಂಡ್, ನ್ಯೂಜಿಲೆಂಡ್ ಹಾಗೂ ಟರ್ಕಿಯಂತಹ ರಾಷ್ಟ್ರ ಗಳು ಇದನ್ನು ಕಾನೂನುಬದ್ಧಗೊಳಿಸಿವೆ. ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ವ್ಯವಸ್ಥಿತವಾಗಿ ನಡೆಸಲು ಅವಕಾಶ ಮಾಡಿಕೊಡಲಾಗಿದೆ. ಭಾರತ ಕೂಡ ಈ ದಿಕ್ಕಿನಲ್ಲಿ ಯೋಚಿಸಬೇಕಾದ ತ್ವರಿತ ಅಗತ್ಯವಿದೆ. ಒಂದು ಅಂದಾಜಿನ ಪ್ರಕಾರ ಭಾರತದಲ್ಲಿ 25 ಲಕ್ಷ ಎಚ್‌ಐವಿ ಪೀಡಿತರಿ ದ್ದಾರೆ. ಆಫ್ರಿಕಾದ ನಂತರದ ಸ್ಥಾನ ಭಾರತಕ್ಕೆ! ನಮ್ಮ ಕಾನೂನಿನಲ್ಲಿ ವೇಶ್ಯಾವಾಟಿಕೆಗೆ ಅವಕಾಶವಿಲ್ಲ. ಆದರೂ ಇಷ್ಟೊಂದು ಜನ ರೋಗ ಪೀಡಿತರಾಗಿದ್ದಾದರೂ ಹೇಗೆ? ಮುಂಬೈ ಒಂದರಲ್ಲೇ ಒಂದೂವರೆ ಲಕ್ಷ ವೇಶ್ಯೆಯರಿದ್ದಾರೆ. ಮಹಾರಾಷ್ಟ್ರದ ಗೃಹಮಂತ್ರಿ ಆರ್.ಆರ್. ಪಾಟೀಲ್ ಬಾರ್‌ಗರ್ಲ್ಸ್‌ಗಳನ್ನು ನಿಷೇಧ ಮಾಡಿದರು. ಆದರೆ ಅವರು ಏನು ಮಾಡಬೇಕು?

ನಾವು ನೈತಿಕತೆಯ ಬಗ್ಗೆ ಎಷ್ಟೇ ಮಾತನಾಡಿದರೂ ವೇಶ್ಯಾವಾಟಿಕೆ ಯನ್ನು ತಪ್ಪಿಸಲು ಸಾಧ್ಯವಿಲ್ಲ. ಆರ್ಥಿಕ ಸಮಸ್ಯೆ, ನೈಸರ್ಗಿಕ ವಿಕೋಪಗಳಿಂದ ಎದುರಾಗುವ ಸಂಕಷ್ಟ, ರಾಜಕೀಯ ಅರಾಜಕತೆ, ಸಂಘರ್ಷ ಇಂತಹ ಸಮಸ್ಯೆಗಳು ಮಹಿಳೆಯರು ಹಾಗೂ ಮಕ್ಕಳನ್ನು ಅಪಾಯದಂಚಿಗೆ ದೂಡುತ್ತವೆ ಎಂಬುದು ಒಪ್ಪುವಂಥದ್ದೇ. ಹಾಗಂತ ದೇಹವನ್ನು ಗುಲಾಮಗಿರಿಗೆ ಇಡುವುದನ್ನು ತಪ್ಪಿಸಲು ಸಾಧ್ಯವಿಲ್ಲ. ದೈಹಿಕ ಕಾಮನೆಗಳನ್ನು ದೌರ್ಬಲ್ಯ ಅನ್ನುವುದಕ್ಕಿಂತ ಅನಿವಾರ್ಯ ಅಗತ್ಯ ಎನ್ನುವುದೇ ಸರಿ. ಯಾರೋ ಒಬ್ಬನಿಗೆ ಅದು ಬೇಕೆಂದರೆ ಆತ ಯಾವುದಾದರೂ ಮಾರ್ಗದಲ್ಲಿ ಅದನ್ನು ಪಡೆಯಲು ಯತ್ನಿಸುತ್ತಾನೆ. ಅಮೆರಿಕದಂತಹ ರಾಷ್ಟ್ರಕ್ಕೇ ಮಾದಕ ವಸ್ತು ಮಾರಾಟವನ್ನು ತಡೆಯಲು ಸಾಧ್ಯವಾಗಿಲ್ಲ. ಹಾಗಿರುವಾಗ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ತಡೆಯಲು ಸಾಧ್ಯವೆ? ಇವತ್ತು ಭಾರತದಲ್ಲಿ ಏನಾಗುತ್ತಿದೆ ಗಮನಿಸಿ.. ವೇಶ್ಯಾವಾಟಿಕೆಯಲ್ಲಿ ತೊಡಗಿರುವ ಮಹಿಳೆ ದೈಹಿಕ ಹಿಂಸೆಯ ಜತೆ ಆದಾಯ ಹಂಚಿಕೆ ವಿಷಯದಲ್ಲೂ ದೌರ್ಜನ್ಯಕ್ಕೊಳಗಾಗುತ್ತಿದ್ದಾಳೆ. ಕಾನೂನುಬಾಹಿರವಾಗಿ ನಡೆ ಯುವ ವೇಶ್ಯಾವಾಟಿಕೆಯಿಂದ ಫಲಾನುಭವಿಗಳ ಸಂಖ್ಯೆ ಹೆಚ್ಚು. ದೇಹವನ್ನು ಗುಲಾಮಗಿರಿಗೆ ಇಡಬೇಕೆಂದರೂ ಅದನ್ನು ಕದ್ದು ಮುಚ್ಚಿ ಮಾಡಬೇಕು. ಅದಕ್ಕೆ ತಲೆಹಿಡುಕರ ಸಹಾಯ ಬೇಕು, ಅವರಿಗೆ ಪೊಲೀಸರ ಶ್ರೀರಕ್ಷೆ ಅಗತ್ಯ. ಹಾಗಾಗಿ ದೈಹಿಕ ಹಿಂಸೆ ಅನುಭವಿಸುವ ಮಹಿಳೆಗೆ ಬರುವ ಪಾಲು ಅತ್ಯಂತ ಕಡಿಮೆ. ಪೊಲೀಸರು, ಏಜೆಂಟರಿಗೆ ಸಿಂಹಪಾಲು. ಈ ದೃಷ್ಟಿಯಿಂದ ವೇಶ್ಯಾ ವಾಟಿಕೆಯನ್ನು ಲೀಗಲೈಸ್ ಮಾಡುವುದೇ ಉತ್ತಮ. ಅಷ್ಟಕ್ಕೂ ಸಲಿಂಗ ಕಾಮಕ್ಕೆ ಕಾನೂನಿನ ಮುದ್ರೆ ಒತ್ತಲು ಹೊರಟಿರುವವರಿಗೆ ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಲೀಗಲೈಸ್‌ಮಾಡುವುದಕ್ಕೇಕೆ ಅಂಜಿಕೆ? ಎಚ್‌ಐವಿ ಪೀಡಿತನಿಗೆ ಘನತೆಯಿಂದ ಬದುಕುವ ಹಕ್ಕಿದೆ ಎಂದು ವಾದಿಸುವುದಾದರೆ ಒಬ್ಬ ವೇಶ್ಯೆಗೂ ಗೌರವಯುತ ಬದುಕಿನ ಹಕ್ಕಿಲ್ಲವೆ? ಕಾನೂನುಬಾಹಿರವಾಗಿ ಕಾಮಾಟಿಪುರ, ಬುಧವಾರ ಪೇಟೆಯಂತಹ ರೆಡ್‌ಲೈಟ್ ಏರಿಯಾಗಳು ಬೆಳೆಯಲು ಅವಕಾಶ ನೀಡುವುದಕ್ಕಿಂತ ಲೀಗಲೈಸ್‌ಮಾಡುವುದರಲ್ಲೇ ದೇಶ ಹಾಗೂ ಸಮಾಜದ ಒಳಿತಿದೆ.
1. ಹೀಗೆ ಮಾಡುವುದರಿಂದ ಮಕ್ಕಳ, ಮಹಿಳೆಯರ ಮಾರಾಟ, ಕಳ್ಳಸಾಗಣೆ(ಚೈಲ್ಡ್ ಟ್ರಾಫಿಕಿಂಗ್) ಮೇಲೆ ನಿಗಾ ಇಡಬಹುದು. 2. ಅಮಾಯಕ ಹೆಣ್ಣುಮಕ್ಕಳು ಪಿಂಪ್‌ಗಳ ಪಿತೂರಿಗೆ ಸಿಲುಕುವುದನ್ನು ತಪ್ಪಿಸಬಹುದು. 3. ಅನಿವಾರ್ಯವಾಗಿ ವೇಶ್ಯಾವಾಟಿಕೆಗೆ ತಳ್ಳಿಸಿಕೊಳ್ಳುವುದನ್ನೂ ನಿಯಂತ್ರಿಸಬಹುದು. 4. ಆದಾಯದ ವಿಷಯದಲ್ಲೂ ಮಹಿಳೆಗೇ ಸಂಪೂರ್ಣ ಫಲ ದೊರೆಯುವಂತೆ ಮಾಡಬಹುದು. 5. ಪಿಂಪ್‌ಗಳ ಕೈಯಲ್ಲಿ ಸಿಕ್ಕಿ ಶಾಶ್ವತವಾಗಿ ನರಳುವುದನ್ನು ತಡೆಯಬಹುದು. 6. ಇಂಥ ಸ್ಥಳದಲ್ಲಿ ಲಭ್ಯವಿದೆ ಎಂಬ ಮಾಹಿತಿ ಮೊದಲೇ ತಿಳಿದಿರುವುದರಿಂದ ರಸ್ತೆ ಬದಿಯಲ್ಲಿ ನಿಂತು ವಿಚಿತ್ರ ಹಾವ-ಭಾವಗಳ ಮೂಲಕ ಆತ್ಮಗೌರವ ಬಿಟ್ಟು ಗಿರಾಕಿಗಳನ್ನು ಆಕರ್ಷಿಸುವ ಅಗತ್ಯವೂ ಬರುವುದಿಲ್ಲ. 7. ಸೆಕ್ಸ್ ವರ್ಕರ್ಸ್‌ಗಳನ್ನು ಇಂತಿಷ್ಟು ಕಾಲಮಿತಿಗೊಮ್ಮೆ ಆರೋಗ್ಯ ತಪಾ ಸಣೆಗೆ ಒಳಪಡಿಸಬಹುದು. 8. ರೋಗಪೀಡಿತರಿಗೆ ಪುನರ್ವಸತಿ ಕಲ್ಪಿಸಬಹುದು. 9. ಅವರಿಗೆ ಆರೋಗ್ಯ ಸೇವೆ ನೀಡಬಹುದು. 10. ಅವರ ಮಕ್ಕಳಿಗೆ ಸರಕಾರವೇ ಸೂಕ್ತ ಶಿಕ್ಷಣ, ವಸತಿ ಮುಂತಾದ ಸೌಲಭ್ಯಗಳನ್ನು ಕಲ್ಪಿಸಬಹುದು. 11. ಮಕ್ಕಳನ್ನು ಶಾಲೆಗೆ ಸೇರಿಸುವಾಗಲೂ ಯಾವುದೇ ಸಮಸ್ಯೆ ಎದುರಾಗುವುದಿಲ್ಲ, ಅಪ್ಪ ಯಾರೆಂದು ಕೇಳುವ, ಮುಜುಗರಕ್ಕೆ ಒಳಗಾಗುವ ಪರಿಸ್ಥಿತಿಯೂ ಇರುವುದಿಲ್ಲ. ತಾಯಿಯ ಹೆಸರೊಂದನ್ನೇ ತುಂಬುವ ಅವಕಾಶ ನೀಡಿದರೆ ಒಳ್ಳೆಯದಾಗುವುದು. 12. ಒಬ್ಬ ಡ್ರೈವರ್ ರಸ್ತೆ ಬದಿಯಲ್ಲಿ ಅಸುರಕ್ಷಿತವಾಗಿ ಕಾಮತೃಷೆ ತೀರಿಸಿಕೊಂಡು, ಹೆಂಡತಿಗೆ ರೋಗ ಅಂಟಿಸುವುದು, ಮಕ್ಕಳಿಗೂ ಬಳುವಳಿಯಾಗಿ ನೀಡುವುದನ್ನು ತಡೆಯಬಹುದು. 13. ಆ ಮೂಲಕ ಸಮಾಜದ ದೈಹಿಕ ಸ್ವಾಸ್ಥ್ಯವನ್ನೂ ಕಾಪಾಡಬಹುದು. 14. ವೇಶ್ಯಾವಾಟಿಕೆಯನ್ನು ಕಾನೂನು ವ್ಯಾಪ್ತಿಗೆ ತರುವುದರ ಮತ್ತೊಂದು ಲಾಭವೆಂದರೆ ಪೊಲೀಸರ ಜವಾಬ್ದಾರಿ ಕಡಿಮೆಯಾಗಿ ಅವರು ಇತರ ಸಮಸ್ಯೆಗಳತ್ತ ಗಮನಹರಿಸಬಹುದು.
ಮೊದಲೇ ಹೇಳಿದಂತೆ ಭಾರತದಲ್ಲಿ 25 ಲಕ್ಷ ಎಚ್‌ಐವಿ ಪೀಡಿತ ರಿದ್ದು, ಪರಿಸ್ಥಿತಿ ಇದೇ ರೀತಿ ಮುಂದುವರಿದರೆ ಮತ್ತೊಂದು ಆಫ್ರಿಕಾ ವಾದೀತು ಎಂದು ಭಯಪಡುವುದಕ್ಕಿಂತ ಮಾನ್ಯತೆ ನೀಡುವುದೇ ಒಳಿತು. ರೋಗಪ್ರಸರಣವನ್ನಾದರೂ ತಡೆಯಬಹುದು. ಲೀಗಲೈಸ್ ಮಾಡಿ, ಕಾಂಡೋಮ್ ವಿತರಣೆ ಮೂಲಕ ರೋಗ ಹರಡುವಿಕೆ ಯನ್ನು ಗಣನೀಯವಾಗಿ ನಿಯಂತ್ರಣ ಮಾಡಿರುವ ಥಾಯ್ಲೆಂಡ್ ಉದಾಹರಣೆ ನಮ್ಮ ಕಣ್ಣಮುಂದಿದೆ. ಆಸ್ಪತ್ರೆಗಳ ಮುಂದೆ ಎಚ್ಚರಿಕೆಯ ಸೂಚನಾ ಫಲಕಗಳನ್ನು ನೇತುಹಾಕುವುದಕ್ಕಿಂತ ಇದು ಉತ್ತಮ ಮಾರ್ಗ. ಹಾಗೆ ಮಾಡಿದ ಮಾತ್ರಕ್ಕೆ ಸಮಾಜ ಹಾಳಾಗಿ ಹೋಗುತ್ತದೆ, ಉಳಿದವರೂ ಪ್ರೋತ್ಸಾಹಿತರಾಗಿ ವೇಶ್ಯಾವೃತ್ತಿಗೆ ಇಳಿದು ಬಿಡುತ್ತಾರೆ ಎಂದು ಭಾವಿಸಬೇಡಿ. ಅದೊಂದು ಮಿಥ್ ಅಷ್ಟೇ. ದೇಹ ಮಾರಿಕೊಳ್ಳಬೇಕೆಂದುಕೊಂಡವರಿಗೆ ಮಾರ್ಗಗಳು ನೂರಾರಿವೆ.
ಇವತ್ತು ಸೆಕ್ಸ್ ಕೂಡ ಒಂದು ಸರ್ವೀಸ್ ಇಂಡಸ್ಟ್ರಿ. ಅದನ್ನು ‘ಫಿಸಿಕಲ್ ಪ್ರಾಸ್ಟಿಟ್ಯೂಶನ್’ ಅನ್ನುವುದನ್ನು ಬಿಟ್ಟರೆ ಬೇರಾವ ವ್ಯತ್ಯಾಸಗಳೂ ಇಲ್ಲ. ನಮ್ಮ ವಿವಿಗಳಲ್ಲಿ ಐಡಿಯಲಾಜಿಕಲ್, ಇಂಟೆಲೆಕ್ಚುವಲ್ ಪ್ರಾಸ್ಟಿಟ್ಯೂಶನ್ ಮಾಡುವವರು ಅದೆಷ್ಟು ಜನರಿಲ್ಲ ಹೇಳಿ?! ಕೃಷ್ಣ ದೇವರಾಯನಿಗೆ 500 ಪತ್ನಿಯರಿದ್ದರು ಎಂದು ನಮ್ಮ ಇತಿಹಾಸದ ಪುಟಗಳು ಹೇಳುತ್ತವೆ. ೫೦೦ ಪತ್ನಿಯರು ಎಂದರೆ ಪರಮವೀರ ಚಕ್ರ, ಅಶೋಕ ಚಕ್ರ, ವೀರ ಚಕ್ರದಂತೆ ಶೌರ್ಯ ಪ್ರಶಸ್ತಿಗಳೇನು? ಈಗಂತೂ ಕಚೇರಿಯಲ್ಲಿರುವ ಕೆಳಸ್ತರದ ಉದ್ಯೋಗಿಗಳನ್ನು ಪುಸಲಾಯಿಸುವುದು, ಪೀಡಿಸುವುದು, ಬಾಲಿವುಡ್ ನಟ ಶೈನಿ ಅಹುಜಾನಂತೆ ಮನೆಗೆಲಸದವಳನ್ನು ಮಂಚಕ್ಕೆ ಎಳೆದುಕೊಳ್ಳುವುದು ಸರ್ವೇ ಸಾಮಾನ್ಯವಾಗಿ ಬಿಟ್ಟಿದೆ. ಇನ್ನು ಅಮರ ಪ್ರೇಮದ ಕಥೆ ಹೇಳುತ್ತಾ ಹೆಂಡತಿ ಇರುವಾಗಲೇ ಮತ್ತೊಬ್ಬಳನ್ನು ಕದ್ದುಮುಚ್ಚಿ ಕಟ್ಟಿಕೊಂಡು ಪುತ್ರಕಾಮೇಷ್ಠಿ ಯಾಗ ಮಾಡಿ, ‘ರಾಧಿಕಾ ಮತ್ತೆ ಮರಿ ಹಾಕಿದಳಾ?’ ಎಂದು ಅನ್ಯರಿಗೆ ನೈತಿಕ ಪಾಠ ಹೇಳುವ ಪತ್ರಕರ್ತರೂ ಕಡಿಮೆಯೇನಿಲ್ಲ! ಆದರೆ ಹೆಣ್ಣನ್ನು ವೇಶ್ಯೆ ಮಾಡಿರುವವನೇ ಗಂಡಸು ಎಂಬುದನ್ನು ಮರೆಯದಿರಿ. ಆಕೆಯ ಬಗ್ಗೆ ಲಘುವಾಗಿ ಮಾತನಾಡುವ, ವೇಶ್ಯೆ ಎಂದು ಜರಿಯುವ ಬದಲು ಗೌರವಿಸುವುದನ್ನೂ ಕಲಿಯಿರಿ.

Legalization/ decriminalization of prostitution may lead to following problems:
1. May become a gift to pimps, traffickers and the sex industry. Pimps may turn into entrepreneurs or third party businessmen. Men who buy women for sexual activity may be legitimate consumers.
2. Sex industry may promote sex trafficking. After the legalization of prostitution, 80% of women in the brothels in the Netherlands are trafficked from other countries, with 70% from Central and Eastern European countries. 75% of the prostituted women in Germany are from Latin American countries, Eastern Europe and former Soviet countries. In Australia, trafficking in East Asian women for the sex trade is a growing problem.
3. Increases clandestine, hidden illegal and street prostitution.
4. The sex industry increases child prostitution. Child prostitution in the Netherlands has increased dramatically and a great number of children are trafficked from Africa. More children from Laos, Burma, Cambodia and China is trafficked to Thailand and within the country from the rural areas to big cities.
5. May not protect the women in prostitution. Studies indicate that prostitution establishments do little to protect prostituted women; they only protect the customers. Behind closed doors anything can happen- there is no one to “protect” the women.
6. Increases the demand for prostitution. It boosts the motivation of men to buy women for sex in a much wider and more permissible range of socially acceptable settings. When the legal barriers disappear, so too do the social and ethical barriers to treating women as sexual commodities. Legalization of prostitution sends the wrong message to men and boys that women are sexual commodities and that prostitution is harmless fun.
7. May not promote women’s health. The mandated health checks and certification are required only for women and not for clients. Women are not protected from HIV/AIDS or STDs. A survey of young Thai HIV-positive males showed that condoms were not used at all during their sexual activities.
So before making prostitution legal, its better government should think over these problems.

I believe legalising prostitution is not a solution. Prostitution is easy money and women are ready to bear the physical pain to gain that easy money. It is just another way of enjoying it. People always find a solution to take advantage from it. The roots of prostitution are poverty, unemployment and illiteracy. All this can be cured by our own Gandhian principles- concept of Swaraj and importance of primary education. The development must start from grass root level- i.e. village. This is mainly to divert the attention from resolving to prostitution to other forms of legal employment which helps in creating a healthy society.

I really don’t know what is going on between Mr Ravi Belagere and Mr Pratap Simha. I am not living in India from last 4 years..so I have lost touch of all these things. I am no fan of Mr Belagere or Mr Simha. I accidentally stumbled upon this article and I am intrigued by the views expressed by Mr Pratap Simha. Here are my views/questions:
1. Robbery, murders, gangwars etc are also illegal and we have not been successful in stopping them completely…so did any one think legalising these as we cannot stop them? Prostitution is also the same way..just because we couldnot stop it from happening, doesn’t mean that we should legalise it.
2. Indian culture is distinct because of its family values. Making prostitution legal will remove one more mental barrier for men/women from going to or becoming prostitutes. I agree that people who are determined to go to prostitues will go to prostitutes whether it is legal or illegal. But there are certainly people who don’t go to prostitues just because it is illegal. A person who doesn’t want to stray because of this mental barrier can freely go to a prostitute if it is made legal. I don’t think an Indian woman or an Indian family system is mature or strong to handle this kind of a situation.We don’t steal things because the sense that it is illegal/wrong and fear of punishment deters us from doing that. If there was no such deterrent, then every where we would just see looting.
3. In the USA where women are pretty much independent who wouldn’t think twice to divorce a husband if they come to know that he went to a prostitute, prostitution is illegal (except for the some counties in the state of Nevada) stating the reason that it disturbs the community order. Definitely it exists throughout US, but it is illegal. In India, a woman who comes to know that her husband was with a prostitute has no way to go. She either has to live with him in resentment or divorce him and most probably live a single life. How many men in India are ready to marry a divorced woman? I don’t think it is a good idea to put one woman’s life in jeopardy just to raise the income of some other woman.
4. How is it possible to stop AIDS by making prostitution legal? Education is the thing that can stop AIDS from spreading, not making prostitution legal. Instead of advocating for legalising prostitition, please advocate sex education classes from 7th to 10th grade. This will do a better job in curbing AIDS.
5. Making prostitution legal is like giving licence for pimps to run brothels. They can harass, abuse and exploit women without any fear of police intervention. There will be no way for girls/women who were forced into prostitution to get out of it because everything will be legal and there will be no questioning done whatsoever about what is going on inside.
6. There are two kinds of women who get into prostitution, first kind are the destitutes in a very bad condition, who can be easily exploited (I have real sympathy for these women), second kind are the lazy a**es who doesn’t want to work hard to earn their bread. We should improve the overall condition of women in the society so that the helpless(the first kind) doesn’t have to get into prostitution because of her condition. Second kind will be prostitutes no matter what. Using protection during servicing their clients is the least thing they can do to protect themselves and their clients. So there is no need to make prostitution legal and remove the marginal protection that innocent women have.
7. There are lot of things that are stated here. Like trafikking of women can be monitored, all income can go to the prostitute herself, she can be saved from a pimp or can be stopped from getting forced into prostitution…but how? How does legalising prostitution can acheive all these things? Why should the government provide healthcare for HIV infected prostitutes once it is made legal? Why should their children get any speical accomodation for education? Once it is legal, they don’t (and shoudn’t) get any special preferences. They are providing some services to their clients in the same way as a software company provides it’s services to clients. Do software engineers get a special preference from the government? If they expect to be treated with respect, then they should expect equality in these aspects also.
I understand that making prostitution legal may look like very broadminded argument..but it certainly does more harm than good…

I agree with gowri akka’s comment. kaama is natural but we cannot legalize it sir. If so, then you must legalize other natural instincts like kroda (a new law may be to allow murdering of one’s enemy, etc) loba (making money by selling things for high rate, etc). It MAY be correct that prostitution is oldest holy profession but one must think that bad or unholy is there since the time of creation. Good and Bad is there from time im-memorable. The percentage may have changed.
There is indeed holy as well as unholy about sex! If sex is used between 2 equal minded and intelligent man and woman with cool mindset to beget a good children to the society then it is holy. Remember that science tells that the mindset of the child who is born depends on the mindset of the parents at the time of sex. If it is used to fulfil a intermittent temporary enjoyment and to advantage of the opposite gender’s weakness then it is unholy.
Spiritually speaking the enjoyment that men/women crave for sex is due to the body/sense organs which God has given and we must win over this provoking of the body machine to reach the goal of life. That is what most religions say. The real self or consciousness in this body do not have that craving. Even disease, hunger, thirsty, anger is due to the self staying in the body which is hard to control for some person. The existence of aathma is also confirmed by some scientific researches though it may not be accepted by mainstream science. There is aathma which is independent of body. We must learn how to live life by maintaining or controlling the bodily urges. This is the real sex education we need to spread to human. Another solution may be to allowing to marry more than 1 women but law must make sure that they are not humiliated. However, Yoga or knowledge about the soul (that all the urges comes from the senses and I am not this body or senses) is the real solutions that heps to control one’s temptation.
There are many kaama-andas (who cannot control sex for every minute they live) in the world and even if they enjoy the sex, the craving will decrease for few minutes/hours but will get doubled after some time and reach a stage they cannot live (more than like we are used to mobile; can tell that they will be like used to drugs) without it. In such a stage, a person will attack any women due to money or distance constraints just to satisfy his instinct. This will lead to forcefully-snatching the freedom of the women in the society.
You are allowing the mental disorder of a person to continue instead of trying to give medicine. The itching will not stop (in fact it will deteriorate the situation) if a doctor allows the patience to continues to tickle the part of his body that is itching. legalizing the prostitution will aggravate the problem.
One thing I learn is that there are many such problems in this world for which there is no specific solution that cures it hundred percent but we must control it by balancing between the freedom and responsibility. Attraction has 2 functions: it can make a person feel good and adore it or simply forget it later. The worst part is that he may get distract by the attraction and starts behaving insane slowly. The main idea is that women must be educated that they wear dresses that is not distracting to men. I know that women has freedom to wear anything she likes in a good government but we must first understand that for every freedom there is a social responsibility. If a RSS leader makes a inflammatory speech and then says that he is not the cuase of the riots that has recently happened, you would say that inflammatory speech was the disttraction to the mob. Of course, not everyone got distracted. Some who do not have control over his feelling got distracted and created the riots. Now sam thing holds good in the case if women dresses by exposing her body. Those who have less control over their sexual urge will get distractted and involve criminal activities like rape or do not get involved in the work at that point of time mentally. So all women must try to balance between their social duty and freedom. Of course the level of distraction will vary between people but that doesn’t mean that whether women should cover her whole body or wear less dress. They must dress modesty. Ofcourse the word modest has different opinions but at least it must not be ignored completely in the case of women. Today’s world has somehow completely ignored the quality of modesty as far as women is concerned.
