ಬಿದರಿ ಸದ್ದಾಂ ಆದರೆ, ಸೇನಾ ನಾಯಕರನ್ನು ಯಾರಿಗೆ ಹೋಲಿಸುತ್ತೀರಿ?

ಗೃಹ ಸಚಿವ ಪಿ. ಚಿದಂಬರಂ ಅವರಿಗೇ ದಿಗ್ಭ್ರಮೆಯುಂಟಾಗಿದೆ! ಪ್ರತಿಕ್ರಿಯೆ ಕೇಳಿದರೆ, ‘ನ್ಯಾಯಾಲಯದ ತೀರ್ಪಿನಲ್ಲಿ ಉಲ್ಲೇಖಗೊಂಡಿರುವ ವಿಚಾರದ ಬಗ್ಗೆ ಹೇಗೆ ತಾನೇ ಪ್ರತಿಕ್ರಿಯಿಸಲಿ? ಆದರೆ… ಹೈಕೋರ್ಟ್್ನಂಥ ನ್ಯಾಯದಂಗಳದ ತೀರ್ಪಿನಲ್ಲಿ ಈ ರೀತಿಯ ಹೋಲಿಕೆ ಮಾಡಿರುವುದು ದುರದೃಷ್ಟಕರ’ ಎಂದು ತಮ್ಮ ಅಸಮಾಧಾನವನ್ನು ವ್ಯಕ್ತಪಡಿಸಿದ್ದಾರೆ. ನಮ್ಮ ತಕರಾರೂ ಅದೇ. ಈ ಕ್ಷಣಕ್ಕೆ ಕರ್ನಾಟಕದ ಒಬ್ಬ ಸಾಮಾನ್ಯ ಮನುಷ್ಯನ ಮನವನ್ನೂ ಕಾಡುತ್ತಿರುವುದೂ ಇದೇ ವಿಷಯ. ಹಾಗಂತ ಯಾರೂ ತೀರ್ಪಿನ ಬಗ್ಗೆ ಅಸಮಾಧಾನವನ್ನಾಗಲಿ, ಅಪಸ್ವರವನ್ನಾಗಲಿ ಎತ್ತುತ್ತಿಲ್ಲ. ಆದರೆ ತೀರ್ಪು ನೀಡುವಾಗ ಬಳಸಿರುವ ಭಾಷೆ, ಮಾಡಿರುವ ಟೀಕೆ-ಟಿಪ್ಪಣಿಗಳು ಯಾವ ಮಟ್ಟದ್ದಾಗಿವೆ?
ಸಿಎಟಿ ಆದೇಶಕ್ಕೆ ತಡೆಕೋರಿ ಶಂಕರ್ ಬಿದರಿ ಹಾಗೂ ಸರ್ಕಾರ ಸಲ್ಲಿಸಿದ್ದ ಮೇಲ್ಮನವಿಯನ್ನು ವಜಾಮಾಡಿದ ಹೈಕೋರ್ಟ್್ನ ವಿಭಾಗೀಯ ಪೀಠ, ‘ಬಿದರಿ ನೇತೃತ್ವದ ವಿಶೇಷ ಕಾರ್ಯಪಡೆ(ಎಸ್್ಟಿಎಫ್) ಎಸಗಿದೆ ಎನ್ನಲಾದ ದೌರ್ಜನ್ಯಗಳ ಬಗ್ಗೆ ನ್ಯಾ. ಎ.ಜೆ. ಸದಾಶಿವ ನೇತೃತ್ವದ ವಿಚಾರಣಾ ಆಯೋಗದ ಮುಂದೆ ಬುಡಕಟ್ಟು ಮಹಿಳೆಯರು ನೀಡಿರುವ ಅಫಿಡವಿಟ್್ಗಳು ನಿಜವೆಂದಾದರೆ ಶಂಕರ್ ಬಿದರಿ ಲಿಬಿಯಾದ ಸರ್ವಾಧಿಕಾರಿ ಕರ್ನಲ್ ಗಡಾಫಿ ಹಾಗೂ ಇರಾಕ್್ನ ಸದ್ದಾಂ ಹುಸೇನ್್ಗಿಂತ ಕಡೆ, ಕೀಳು’ ಎಂದಿದೆ!
ಇಂಥದ್ದೊಂದು ಹೋಲಿಕೆಯನ್ನು ಮಾಡಲೇಬೇಕಾದ ಅಗತ್ಯವಾದರೂ ಏನಿತ್ತು ಹೇಳಿ?
ನಲವತ್ತೊಂದು ವರ್ಷಗಳ ಕಾಲ ಲಿಬಿಯಾವನ್ನು ತನ್ನ ಕಪಿಮುಷ್ಟಿಯಲ್ಲಿಟ್ಟುಕೊಂಡಿದ್ದ ಗಡಾಫಿಯಿಂದ ಹತ್ಯೆಗೊಳಗಾದವರ ಸಂಖ್ಯೆ ಲೆಕ್ಕಕ್ಕೇ ಸಿಗುವುದಿಲ್ಲ. ಜನರ ಧ್ವನಿಯನ್ನೇ ಉಡುಗಿಸಿದ್ದ, ಪ್ರಜಾತಂತ್ರವನ್ನೇ ಕೊಲೆಗೈದಿದ್ದ, ಸ್ವಂತ ಸುಖಕ್ಕೆ ದೇಶವನ್ನೇ ಭೋಗಕ್ಕಿಟ್ಟುಕೊಂಡಿದ್ದ, ವಿರೋಧಿಗಳನ್ನು ನಿರ್ದಯವಾಗಿ ಮಟ್ಟಹಾಕಿದ ಪಾತಕಿ ಆತ. ಇನ್ನು 24 ವರ್ಷ ಇರಾಕನ್ನಾಳಿದ ಸದ್ದಾಂ ಹುಸೇನ್ ಹುಚ್ಚಾಟಕ್ಕೆ ತುತ್ತಾದ ಕುರ್ದಿಶ್ ಮುಸ್ಲಿಮರ ಸಂಖ್ಯೆ 2 ಲಕ್ಷ! ಇರಾನ್ ಮೇಲೆ ಯುದ್ದ ಸಾರಿದಾಗ ಸತ್ತವರ ಸಂಖ್ಯೆ 3 ಲಕ್ಷಕ್ಕೂ ಹೆಚ್ಚು. ಒಟ್ಟು ಇಪ್ಪತ್ತು ಲಕ್ಷಕ್ಕೂ ಹೆಚ್ಚು ಜನರ ಮಾರಣಹೋಮಕ್ಕೆ ಕಾರಣರಾದ ಆರೋಪ ಅವರ ಮೇಲಿದೆ. ಮುಸ್ಲಿಂ ರಾಷ್ಟ್ರವೇ ಆದರೂ ಕುವೈತನ್ನು ಕಬಳಿಸಿ ಅಪಾರ ಸಾವು ನೋವಿಗೆ ಕಾರಣರಾದ, ಸ್ವಂತ ಅಳಿಯಂದಿರನ್ನೇ ಕೊಲ್ಲಿಸಿದ್ದ ಸದ್ದಾಂ ಹುಸೇನ್ ಈ ಮನುಕುಲ ಕಂಡ ಮಹಾನ್ ಪಾಪಿಗಳಲ್ಲಿ ಒಬ್ಬ. ಇಂತಹ ವ್ಯಕ್ತಿಗಳ ಜತೆ ವೀರಪ್ಪನ್್ನ ಜಂಘಾಬಲವನ್ನೇ ಉಡುಗಿಸಿದ, ರಾಜ್ಯದ ಸಂಪತ್ತಿನ ಲೂಟಿಯನ್ನು ನಿಲ್ಲಿಸಿದ, 4 ಬಾರಿ ರಾಷ್ಟ್ರಪತಿ ಪದಕ ಪಡೆದ, ಕಾರ್ಯದಕ್ಷತೆಗೆ ರಾಷ್ಟ್ರಮಟ್ಟದಲ್ಲಿ ಹೆಸರು ಪಡೆದಿರುವ ಶಂಕರ್ ಮಹಾದೇವ ಬಿದರಿಯವರನ್ನು ಹೋಲಿಸಿದ್ದು ಎಷ್ಟು ಸರಿ? ಸದ್ದಾಂ, ಗಡಾಫಿ ಮಾಡಿದಂಥ ಯಾವ ಪಾಪ ಕಾರ್ಯವನ್ನು ಬಿದರಿ ಎಸಗಿದ್ದಾರೆ? ಖಂಡಿತ Words are free.. ಪದಗಳು ಪುಕ್ಕಟೆಯಾಗಿ ಸಿಗುತ್ತವೆ ಅಂತ ಏನು ಬೇಕಾದರೂ ಮಾತನಾಡಬಹುದೇ?
ಸುಪ್ರೀಂಕೋರ್ಟ್್ನ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿಗಳಾಗಿದ್ದ ಕೆ.ಜಿ.ಬಾಲಕೃಷ್ಣನ್, ವೈ.ಕೆ. ಸಬರ್್ವಾಲ್್ರಂಥವರ ನ್ಯಾಯಪರತೆ, ಸಮಗ್ರತೆ, ವಿಶ್ವಾಸಾರ್ಹತೆಯ ಬಗ್ಗೆಯೇ ಅನುಮಾನಗಳೆದಿದ್ದರೂ ನಮ್ಮ ಸಮಾಜ ನ್ಯಾಯಾಲಯಗಳ ಬಗ್ಗೆ ದೈವೀ ಭಾವನೆ, ಗೌರವ, ವಿಶ್ವಾಸವನ್ನು ಹೊಂದಿದೆ.
ನ್ಯಾಯಾಲಯಗಳಿಂದ ಬಂದಿದ್ದಷ್ಟೇ “ವೇದವಾಕ್ಯ”ವಾಗುತ್ತದೆ, ಆದರೆ ನಮ್ಮ ಹೈಕೋರ್ಟ್ ವಿಭಾಗೀಯ ಪೀಠದ ಮಾತುಗಳನ್ನು ವೇದವಾಕ್ಯಗಳೆಂಬಂತೆ ಕಾಣಲು, ಆದರ್ಶವಾಗಿಟ್ಟುಕೊಳ್ಳಲು ಸಾಧ್ಯವೆ? ನ್ಯಾಯಾಲಯಗಳು ಮೇಲ್ಪಂಕ್ತಿ ಹಾಕಿಕೊಡುವುದನ್ನು ಬಿಟ್ಟು ತಮ್ಮ ಭಾಷೆಯನ್ನು ಲೇಮ್ಯಾನ್ ಮಟ್ಟಕ್ಕೆ ಇಳಿಸಿಕೊಳ್ಳಲು ಹೊರಟರೆ ಸಮಾಜಕ್ಕೆ ಯಾವ ಸಂದೇಶ ದೊರೆಯುತ್ತದೆ?
ಹಾಗಂತ ನಾವ್ಯಾರೂ ತೀರ್ಪನ್ನು ಪ್ರಶ್ನಿಸುತ್ತಿಲ್ಲ. ಆದರೆ ತೀರ್ಪು ನೀಡುವಾಗ ಮಾಡಿರುವ ಟಿಪ್ಪಣಿ, ಅದರ ಹಿಂದಿರುವ ಧ್ವನಿ, “ದೃಷ್ಟಿ”ಕೋನ, ಇಂಗಿತ ಎಂಥದ್ದು? ಇಂಥ ಹೋಲಿಕೆಗಳು ಇಡೀ ತೀರ್ಪಿಗೆ ನಂಜನ್ನು ಅಂಟಿಸುವುದಿಲ್ಲವೆ? “ನಾನೇನು ಸರ್ವಾಧಿಕಾರ ಮೆರೆದಿರಲಿಲ್ಲ. ವೀರಪ್ಪನ್ ಕಾರ್ಯಾಚರಣೆ ವೇಳೆ ಬುಡಕಟ್ಟು ಮಹಿಳೆಯರ ಮೇಲೆ ದೌರ್ಜನ್ಯ ನಡೆದಿದ್ದರೆ ನನ್ನೊಂದಿಗಿದ್ದ ಎಡಿಜಿಪಿ, ಡಿಸಿಪಿಗಳೂ ಸಮಾನ ಪಾಲುದಾರರಾಗುತ್ತಾರೆ” ಎಂದು ಬಿದರಿಯವರು ಮಾಡಿಕೊಂಡಿದ್ದ ಸಮರ್ಥನೆಯ ಬಗ್ಗೆ ಕಿಡಿ ಕಾರುತ್ತಾ, “ಇದು ಬಿದರಿ ಮನಸ್ಥಿತಿಯ ಪ್ರತಿಬಿಂಬ. ಅವರಿಗೆ ಪಾಪಪ್ರಜ್ಞೆಯೇ ಕಾಡುತ್ತಿಲ್ಲ. ಬಡವರು, ಅಸಹಾಯಕರ ಬಗ್ಗೆ ಕನಿಕರವಿಲ್ಲದವರು ಗಡಾಫಿಗಿಂತ ಹೀನ. ಇಂತಹ ವ್ಯಕ್ತಿಗಳು ಪೊಲೀಸ್ ವ್ಯವಸ್ಥೆಯ ನೇತೃತ್ವ ವಹಿಸಲು ಅರ್ಹರಲ್ಲ” ಎಂದಿದೆ!
ಒಂದು ವೇಳೆ ಇದೇ ತರ್ಕವನ್ನು ಇಟ್ಟುಕೊಂಡು ಹೋದರೆ ಕಾಶ್ಮೀರದಲ್ಲಿ, ಮಣಿಪುರದಲ್ಲಿ ನಮ್ಮ ಸೇನಾಪಡೆಗಳ ಮೇಲೂ ಇದೇ ತೆರನಾದ ಆರೋಪಗಳಿವೆ. ಕಾಶ್ಮೀರದಲ್ಲಿ ಅಮಾಯಕರು ಬಲಿಪಶುಗಳಾದ ನೂರಾರು ಉದಾಹರಣೆಗಳಿವೆ, ಅಲ್ಲೂ ಸೈನಿಕರಿಂದ ಅತ್ಯಾಚಾರಗಳು ನಡೆದಿವೆ, ಇಂದಿಗೂ ನಡೆಯುತ್ತಲೇ ಇವೆ. ಹಾಗೆ ಆದ ತಪ್ಪುಗಳಿಗೆಲ್ಲ ಸೇನಾ ಮುಖ್ಯಸ್ಥರನ್ನು ಹೊಣೆ ಮಾಡುವುದಕ್ಕಾಗುತ್ತದೆಯೇ? ಮಣಿಪುರದಲ್ಲಿ ಸೇನೆಯಿಂದ ನಡೆಯುತ್ತಿರುವ ದೌರ್ಜನ್ಯ ಹಾಗೂ ಸೇನೆಗೆ ಸರ್ವಾಧಿಕಾರ ಕೊಟ್ಟಿರುವ 1958ರ ವಿಶೇಷ ಕಾಯಿದೆಯನ್ನು(AFSPA) ಹಿಂದೆ ತೆಗೆದುಕೊಳ್ಳುವಂತೆ ಎರಡು ದಿನಗಳ ಹಿಂದಷ್ಟೇ ವಿಶ್ವಸಂಸ್ಥೆಯೇ ಭಾರತವನ್ನು ಒತ್ತಾಯಿಸಿದೆ. ಇದಕ್ಕೆಲ್ಲ ಯಾರನ್ನು ಹೊಣೆ ಮಾಡಬೇಕು? 1990ರ ದಶಕದಲ್ಲಂತೂ ಪ್ರತಿವರ್ಷವೂ ಅಂತಾರಾಷ್ಟ್ರೀಯ ಮಾನವ ಹಕ್ಕು ಸಂಸ್ಥೆ “ಅಮ್ನೆಸ್ಟಿ ಇಂಟರ್್ನ್ಯಾಷನಲ್್” ಕಾಶ್ಮೀರದಲ್ಲಿ ಸೇನೆಯಿಂದ ಮಾನವಹಕ್ಕು ಉಲ್ಲಂಘನೆಯಾಗುತ್ತಿದೆ ಎಂದು ಆರೋಪಿಸುತ್ತಿತ್ತು. ಹಾಗಾದರೆ ನಮ್ಮ ಸೇನಾ ಜನರಲ್್ಗಳನ್ನೂ ಸದ್ದಾಂ, ಗಡಾಫಿಗೆ ಹೋಲಿಸುತ್ತೀರಾ? ಇನ್ನು ಮೂರೂ ಪಡೆಗಳ ಸುಪ್ರೀಂ ಕಮಾಂಡರ್ ಆದ ರಾಷ್ಟ್ರಪತಿಯವರನ್ನು ಯಾರಿಗೆ ಹೋಲಿಸಬೇಕು? ವಿಭಾಗೀಯ ಪೀಠದ ಮಾತುಗಳನ್ನೇ ಮಾನದಂಡವಾಗಿಟ್ಟುಕೊಂಡು ಹೋದರೆ ಕಾಶ್ಮೀರದಲ್ಲಿ ಸೇವೆ ಸಲ್ಲಿಸುವ ಮೇಜರ್ ಜನರಲ್್ಗಳು ಎಷ್ಟೇ ಯೋಗ್ಯತೆ, ಅರ್ಹತೆ ಇದ್ದರೂ ಆರ್ಮಿಯ ಜನರಲ್ ಆಗಲು ಸಾಧ್ಯವಿಲ್ಲ ಅಲ್ಲವೆ? ಇಂದು ಸೇನಾ ಪಡೆಗಳ ಮುಖ್ಯಸ್ಥರ ಆಯ್ಕೆಯಲ್ಲೂ ಸೇವಾ ಹಿರಿತನವೊಂದೇ ಮಾನದಂಡವಲ್ಲ. ದಕ್ಷತೆ ಹಾಗೂ ಸಮರ್ಥತೆಗೆ ಹೆಚ್ಚಿನ ಆದ್ಯತೆಗಳನ್ನು ನೀಡುತ್ತಾರೆ. ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಯೋಚಿಸಿದರೆ ಬಿದರಿಯವರಿಗಿಂತ ಸಮರ್ಥ ವ್ಯಕ್ತಿ ಯಾರಿದ್ದಾರೆ? ಡಿಜಿ ಆಯ್ಕೆಯಲ್ಲಿ ಅಂತಿಮ ನಿರ್ಧಾರ ಯಾವತ್ತೂ ಆಳುವ ಸರ್ಕಾರದ ಕೈಯಲ್ಲಿರುತ್ತದೆ. ದೇಶದ ಮೊದಲ ಮಹಿಳಾ ಐಪಿಎಸ್ ಅಧಿಕಾರಿ ಕಿರಣ್ ಬೇಡಿ ದಿಲ್ಲಿ ಪೋಲಿಸ್ ಕಮಿಷನರ್ ಆಯ್ಕೆ ವೇಳೆ ತಮ್ಮನ್ನು ಕಡೆಗಣಿಸಲಾಗಿದೆ ಎಂಬ ಕಾರಣಕ್ಕೆ 2007ರಲ್ಲಿ ಸ್ವಯಂ ನಿವೃತ್ತಿ ತೆಗೆದುಕೊಂಡ ಉದಾಹರಣೆಯೂ ಇದೆ.
ಒಂದು ನ್ಯಾಯಾಲಯ ಕೊಟ್ಟ ತೀರ್ಪನ್ನು ಮೇಲಿನ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಶ್ನಿಸುವುದು ಒಂದು ಸಹಜ ಪ್ರಕ್ರಿಯೆ. ಅಲ್ಲಿ ವ್ಯತಿರಿಕ್ತವಾದ ತೀರ್ಪು ಬಂದು ಗೆದ್ದಿರುವ, ಕೆಲವೊಮ್ಮೆ ಸೋತಿರುವ ಉದಾಹರಣೆಗಳು ಸಾಕಷ್ಟಿವೆ. ಇದಮಿತ್ಥಂ ಎಂಬುದು ಯಾವುದೂ ಇಲ್ಲ. ನಾವು ಹೇಳಿದ್ದೇ ಸರಿ, ಸತ್ಯ ಎಂಬ ಆರೋಗೆನ್ಸ್ ನ್ಯಾಯಾಂಗಗಳಿಗೂ ಒಳಿತಲ್ಲ. ಕಳೆದ ವರ್ಷ ಬಿಜೆಪಿಯ 11 ಬಂಡಾಯ ಶಾಸಕರ ಸದಸ್ಯತ್ವವನ್ನು ರದ್ದುಗೊಳಿಸಿದ ಸ್ಪೀಕರ್ ಆದೇಶವನ್ನು ರಾಜ್ಯ ಹೈಕೋರ್ಟ್ ಎತ್ತಿಹಿಡಿದರೆ ಸುಪ್ರೀಂಕೋರ್ಟ್ ಅಸಂವಿಧಾನಿಕ ಎಂದಿತು. ಮೊನ್ನೆ ತಾನೇ ಮಾಜಿ ಮುಖ್ಯಮಂತ್ರಿ ಯಡಿಯೂರಪ್ಪನವರ ಲಂಚ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಕೇಸನ್ನೇ ಹೈಕೋರ್ಟ್ ವಜಾ ಮಾಡಿದರೆ, ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನೇಮಕ ಮಾಡಿರುವ ಕೇಂದ್ರ ಉನ್ನತಾಧಿಕಾರ ಸಮಿತಿ(ಸಿಇಸಿ), ಲಂಚ ತೆಗೆದುಕೊಂಡಿರುವುದು ಖರೆ, ಹೆಚ್ಚಿನ ತನಿಖೆಯಾಗಬೇಕು ಎಂದಿದೆ. ಹಾಗೆಯೇ ಬಿದರಿಯವರು ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಯ ಬಗ್ಗೆಯೂ ಯಾವ ಕಾರಣಕ್ಕೆ ಡಿಜಿಯಾಗಿ ನೇಮಕ ಮಾಡಿದ್ದು ಅಸಂವಿಧಾನಿಕ ಎಂದಷ್ಟೇ ವಿವರಿಸಿದ್ದರೆ ಯಾರೂ ಬೇಡವೆನ್ನುತ್ತಿರಲಿಲ್ಲ. ಅದನ್ನು ಬಿಟ್ಟು ಸುಖಾಸುಮ್ಮನೆ ಸದ್ದಾಂ ಹುಸೇನ್್ಗೆ ಹೋಲಿಸಿರುವುದನ್ನು ನೋಡಿದರೆ ಉದ್ದೇಶ ಶುದ್ಧಿಯ ಬಗ್ಗೆಯೇ ಅನುಮಾನಗಳೇಳುವುದಿಲ್ಲವೆ? ನಿವೃತ್ತಿಯ ಅಂಚಿನಲ್ಲಿರುವ ಒಬ್ಬ ದಕ್ಷ ಅಧಿಕಾರಿಯ ಚಾರಿತ್ರ್ಯಕ್ಕೇ ಕಳಂಕ ಅಂಟಿಸುವ ಉದ್ದೇಶವಿತ್ತೇನೋ ಎಂಬಂತೆ ಭಾಸವಾಗುವುದಿಲ್ಲವೆ? 1999ರಲ್ಲಿ ಕೇಂದ್ರ ಮಾನವ ಹಕ್ಕು ಆಯೋಗ ನೇಮಕ ಮಾಡಿದ್ದ, ನಿವೃತ್ತ ನ್ಯಾಯಾಧೀಶ ಎಜೆ ಸದಾಶಿವ ಹಾಗೂ ಸಿಬಿಐನ ಮಾಜಿ ನಿರ್ದೇಶಕ ಸಿಎಲ್ ನರಸಿಂಹನ್ ಇದ್ದ ಆಯೋಗವೇ ಬಿದರಿಯವರಿಗೆ ಕ್ಲಿನ್ ಚಿಟ್ ಕೊಟ್ಟಿರುವಾಗ ಈ ಪಾಪಪ್ರಜ್ಞೆಯ ಪ್ರಶ್ನೆ ಎಲ್ಲಿಂದ ಉದ್ಭವಿಸಿತು? ಸದ್ದಾಂಗಿಂತ ಹೀನ ಎಂಬ ವೈಯಕ್ತಿಕ ದಾಳಿಯ ಅಗತ್ಯವೇನಿತ್ತು? ಸದ್ದಾಂ, ಗಡಾಫಿಗೆ ಹೋಲಿಸುವಾಗ ಬಹುಶಃ ಇದಿ ಅಮಿನ್ ಹೆಸರು ನೆನಪಿಗೆ ಬರಲಿಲ್ಲವೆನಿಸುತ್ತದೆ, ಇಲ್ಲವಾದರೆ ಬಿದರಿಯವರನ್ನು ಆತನಿಗೂ ಹೋಲಿಸುತ್ತಿದ್ದರೇನೋ! ಒಬ್ಬ ದಕ್ಷ ಪೊಲೀಸ್ ಅಧಿಕಾರಿ ಎಂದು ಹೆಸರು ಪಡೆದಿರುವ ಬಿದರಿಯವರಿಗೂ ನ್ಯಾಯ-ಅನ್ಯಾಯಗಳ ಅರಿವಿದೆ. ಇಷ್ಟಕ್ಕೂ ಬಿದರಿಯವರೇನು “ಇನ್್ಫ್ಯಾಂಟ್್”(ಬಾಲಕ) ಅಲ್ಲ! ವೀರಪ್ಪನ್ ವಿರುದ್ಧದ ಕಾರ್ಯಾಚರಣೆಯಲ್ಲಿ ಸ್ವಂತ ಪ್ರಾಣವನ್ನು ಅಪಾಯಕ್ಕೆ ಒಡ್ಡಿ ಹೋರಾಡಿದ ವ್ಯಕ್ತಿ ಅವರು.
ವೀರಪ್ಪನ್ 2000 ಆನೆಗಳನ್ನು ಸಾಯಿಸಿದ್ದ ಕ್ರೂರಿ. 250 ಕೋಟಿ ರು.ಗಳಿಗೂ ಹೆಚ್ಚು ಅರಣ್ಯ ಲೂಟಿ ಮಾಡಿದ್ದ. ಕರ್ನಾಟಕ ಹಾಗೂ ತಮಿಳುನಾಡು ಎರಡೂ ರಾಜ್ಯಗಳಿಗೂ ಸಿಂಹಸ್ವಪ್ನನಾಗಿದ್ದ. ಅಂತಹ ವೀರಪ್ಪನ್್ನ ‘ಜಂಗಲ್ ರಾಜ್್’ ಅನ್ನು ನಾಶಪಡಿಸಿದ್ದೇ ಶಂಕರ್ ಬಿದರಿ. ಇಂತಹ ಬಹದ್ದೂರಿಕೆಯನ್ನು ಗುರುತಿಸಿದ ವೀರಪ್ಪನ್್ನ ಹುಟ್ಟೂರಾದ ಗೋಪಿನಾಥಂನ ಜನರೇ ಬಿದರಿಯವರನ್ನು ಕರೆಸಿ ಸನ್ಮಾನ ಮಾಡಿದ್ದರು. ಇವತ್ತಿಗೂ ಅಲ್ಲಿನ ಜನ ಬಿದರಿಯವರನ್ನು ಗೌರವ, ವಿಶ್ವಾಸಗಳಿಂದ ಕಾಣುತ್ತಾರೆ. ದುರದೃಷ್ಟವಶಾತ್ ಟೀಕಿಸಲು ಹೊರಟವರಿಗೆ ಇದೆಲ್ಲಾ ಕಾಣುವುದೇ ಇಲ್ಲ.
ಇದೇನೇ ಇರಲಿ, ಅದು ಪ್ರಜಾಪ್ರಭುತ್ವದ ಯಾವುದೇ ಅಂಗವಾಗಿರಬಹುದು, ಈ “”Holier than thou”“ಆ್ಯಟಿಟ್ಯೂಡನ್ನು ಬಿಡಬೇಕು. ನ್ಯಾಯಾಂಗವನ್ನೂ ಲೋಕಪಾಲದಡಿ ತರಬೇಕು ಎಂಬ ಕೂಗು ದೇಶಾದ್ಯಂತ ಕೇಳಿಬರುತ್ತಿದೆ. ಅದರ ಪರಿಣಾಮವಾಗಿ ಸರ್ಕಾರ “ನ್ಯಾಯಾಂಗೀಯ ಉತ್ತರದಾಯಿತ್ವ ಕಾಯಿದೆ”ಯನ್ನು ಜಾರಿಗೆ ತರಲು ಹೊರಟಿದೆ. ಅದರಲ್ಲಿ ನ್ಯಾಯಾಧೀಶರೂ ಹತೋಟಿ ಮೀರಕೂಡದು ಎಂಬ ಎಲ್ಲೆಯನ್ನೂ ನಿಗದಿ ಪಡಿಸುತ್ತಿದ್ದಾರೆ. ಗೊತ್ತಿದೆಯಲ್ಲವೆ?

really a true story… moreover… this judgement and the words are used in the judgement are really disgusting… i think, it is better to mention somewhere about “tit for tat” against police by judge… recently, advocates attacked journalists and reporters and also police. and judge stand by the side of advocates. and even police officials took protest march against advocates. it means, the fire still burning inside the advocates and judges. thats y they took such worst ever heard words against police. this is really a condemned matter… truely i will support bidari… after-all what is judiciary stands for?

I will support Bidari, As he is loyal police officer from karnataka. everyone in karnataka should proud of him as we have such a eminent police officer in our state. I dont have any respect to judiciary, when they used such a wordings, Judges should be ashamed themselves using such a words without knowing anything about Bidari. Mr.Pratap Simha.. i have been reading your article since very long time n really respect your efforts.. but the above article, seem to be immature because i clearly dis-closes that haven’t read the judgement, and been too furious to give conclusions about mentioning/ bringing names of Saddam and Gadaffi’s name.. just to put the facts straight.. n knowledge what I have is that.. Mr.Bidri had submitted before the High Court in his affidavit that.. “he is not Saddam or Gadaffi to commit the atrocities which are alleged against him “… effectively it is his plea/submission before the Court.. for which Court is bound to give reasoned order. Therefore, in that back ground and also other things i.e., where government conceded to the fact 1) That the Report against Bidri by Sadashivan Committee was placed never before U.P.S.C Or even before the President’s wherein he was awarded earlier. 2) Importantly, where Government has accepted to compensate monetarily to the Victims who sworn against the Bidir i.e., effectively admitting their claim/version. And also having the consideration of factors brought to Court, opinion of the Division bench has recorded that “assuming if the allegations of victims are true then Mr.Bidir is worse then the said persons”. Its time even you carry some maturity.. with due respects to your works all this days i have brought this aspects here.

In my opinion what Mr Bidari meant when he mentioned Saddam and Gaddafi is that they two were supreme (absolute) powers when it came to excercising their power.They had no one above them to seek permissions, while as a commander of the task force he had a herarchy above him which controlled his actions – i.e., he is no as free as the two dictators.
The court rules “assuming if the allegations of victims are true then Mr.Bidari is worse then the said personsâ€. I hope the court did not assume anything here because the commisions appointed and headed by ex-judges have not given negative report (because no victim complained against these officers before the commission – I heard that sifficient time was provided to submt their complaints- as Mr Bidari himself stated in the TV9/Suvarna channels – Muthulakshmi came forward to allege atrocities against the task force after 20 years — the court should also question her why she is gving these staments now and not when it was officially sought
